1. FIELD OF APPLICATION

These General Sales Conditions apply to all purchases of products made remotely via this website (www.andreasmcmuller.art) owned by the company SHIBUSA S.a.s. by Andrea Centrone & c. with registered office in via Pasolini, 8 - 42023 Cadelbosco di Sopra (RE) C.Fisc. and VAT number IT02720390356 hereinafter referred to as "Supplier"

The following General Sales Conditions are an integral part of all our sales contracts.

The Supplier sells the products listed on its website, addressing both a professional clientele (artists, gallery owners, artisans, professionals, merchants, retailers, etc.) and individual consumers (a natural person who acts for purposes that cannot be referred to any professional activity) , hereinafter referred to as "Customer". In the case of direct sales to a "consumer" the relationship between the Producer and his Customer will be governed by consumer protection regulations, Legislative Decree of May 22nd 1999, No. 185.

2. RIGHT OF WITHDRAWAL

The Customer, if it can be qualified as "consumer", as reported in point 1 and with reference to the Legislative Decree 22/05/1999 N.185, can use the right of withdrawal within 10 working days from receipt of the goods, sending back the purchased material to INTEGRATED PACKAGING, with the original documentation, the fiscal and transport documentation received with the same good. Shipping costs ARE NOT REFUNDABLE.

To exercise the right of withdrawal, the Customer must send to the Supplier, through the following e-mail address mcmuller@shibusa.art, the communication of his desire to exercise the return of the goods, taking care to include in the communication the number of the document received with the merchandise and order number. Upon receipt of the aforementioned withdrawal notice, the Supplier will proceed to enable the withdrawal by communicating via e-mail to the Customer the address to which he must return the product. The Supplier will reimburse the Customer, after verifying the integrity of the product, the amount paid, by bank transfer to the bank details that the Customer will provide, or at the Customer's choice, to use the credit for the replacement or purchase of a other article.

In the event that from the checks carried out the product is not intact, the object will be made available to the Customer for its return, simultaneously canceling the request for withdrawal.

3. ACCEPTANCE OF THE GENERAL SALES CONDITIONS

By confirming the order, the Customer unconditionally accepts and undertakes to observe the general sales and payment conditions indicated herein, declaring that he has read and accepted all the information provided to him in accordance with the aforementioned rules, also acknowledging that the Supplier it is not bound to different conditions unless previously agreed in writing.


4. CUSTOMER OBLIGATIONS

The Customer, before confirming his purchases, must carefully read the General Sales Conditions which have been made available on the Site, in order to allow the storage and reproduction by the Customer pursuant to article 12 DL April 9, 2003, No. 70.

The forwarding of the order confirmation therefore implies the total knowledge of these General Sales Conditions and their full acceptance.

It is strictly forbidden for the Customer to enter false and / or invented data in the registration procedure necessary to activate the process for the execution of this contract; the personal data and e-mail address must be exclusively their real data. It is illegal and expressly prohibited to make double entries corresponding to a single company / consumer or to enter data of third parties.

1. 5. QUOTE REQUEST

Any requests for quotations, sent via email, do not in any case represent "executive sales order".

Following these requests, the Supplier will activate itself exclusively in order to provide the information object of the requests.


6. MAKE AN ORDER ON THE WEBSITE www.andreasmcmuller.art

A- The purchase of prints, paintings or any other Product or Service presented on www.andreasmcmuller.art is carried out by the Customer of his own will and is related to the products and services available as described in the relative descriptions and technical details whose details are however, they are to be considered indicative and not binding and may be changed by the supplier as a result of variations in the materials available and the techniques used by the production laboratories, particularly but not exclusively with the intention of improving the Product or service itself. .

SHIBUSA S.a.s. will do its best to ensure that the images of the Products and Services published on the Site, in support of the Technical or Descriptive Sheet of such Product or Service, represent as faithfully as possible the Products and Services offered for sale. However, the colors of the Products may differ from the actual colors due to the settings of the computer systems or the computers used by users for their display. Furthermore, the images of the Product or Service in the Technical Data Sheet may differ in size or in relation to any accessory products. For the purposes of the purchase contract, the description of the Product or Service contained in the order form sent by the Supplier to the Customer will be valid, since the images are merely illustrative.

B- Important artistic and technical note concerning the paintings and prints: being proposed in multiple formats, the published images are to be intended as indicative and the final products could for small aesthetic reasons present small variations from a graphic or dimensional point of view, particularly as regards it concerns the length of the shorter side, which can indicatively vary down or up by 10%.

C- The other services and products occasionally mentioned on the site such as photography courses, personal photographic services and corporate services cannot be purchased through the site and are subject to other legislation.

D- All product prices are VAT excluded, for Italy and EU countries for which VAT is due.

E- Additional customs, packaging, transport and any other markings are charged to the Customer, are calculated based on the size and weight of the goods purchased and are communicated during the order confirmation.

F- Before confirming the purchase, the customer will be shown the unit cost of each selected product, the taxable amount, the I.V.A. amount, transport costs, the total cost and the estimated delivery times. The confirmation of the purchase is made by the Customer by means of payment by bank transfer, PayPal or credit card of the balance of the order or of the account by bank transfer of 50% and then paid before shipment or cash on delivery.

G- As soon as the amount mentioned above is received, the Supplier will send the summary of the order by e-mail and will put the purchased work into production (or send it if it is already available); subsequent communications from the Supplier will inform the Customer that his product has been made and is preparing the shipment and the last that delivery to the courier has been made; this will include the tracking number and the link to the courier's website so that the customer can monitor the delivery of the work purchased by him.

H- The validation of the order is intended only if the Supplier confirms receipt of the balance.

I- The Supplier reserves the right to evaluate the acceptance of the orders received, informing the Customer of the impossibility of accepting them within 72 hours from the working day following that on which the Customer transmitted the order. In this case, the Supplier will refund any amounts already paid by the Customer for payment of the supply.

L - It is stressed that the ordered goods depend exclusively on the will of the Customer, therefore in no case shall it be refused, under penalty of being billed for round-trip transportation costs and any damage. The Supplier, in the event that the customer does not provide compensation for transport costs within 15 days, upon notice by e-mail, will initiate legal proceedings to the detriment of the customer. The order via the internet is recognized as a normal commercial contract stipulated by the buyer by himself.


1. 7. PAYMENTS

The payment of the purchased products and the relative transport costs can be made by the customer both online (as of the activation of this service), and offline.

Online payment is made using the credit cards of the VISA, MASTERCARD or PAYPAL circuits, while the off-line payment can be made in full or in advance only by BANK TRANSFER.


Credit card

VISA and MASTERCARD credit cards are accepted, including VISA ELECTRON, Poste Italiane POSTEPAY card and other cards accepted by PayPal.

The entire payment flow takes place on secure WEB servers, directly on the bank or PayPal website. The data entered during the payment phase will be visible only to the bank / PayPal, no one else will be able to know the credit card number. In case of payment by credit card, the supply will not be made until the issuer of your credit card has authorized the use of the same for the payment of the ordered products. Any failure to receive the aforementioned authorization will be communicated to the Customer. The Supplier reserves the right to verify the identity of the credit card holder by requesting adequate documentation.

Bank transfer

Payment by bank transfer must be received within 5 working days of placing the order. After this date the order will be considered invalid. The reason to be reported on the bank transfer must indicate the number and date of the order confirmation, the company name or the name of the buyer, the coordinates for the transfer are shown in the order confirmation e-mail sent automatically to the client. It is understood that, if the bank transfer is chosen, the goods will be sent only after verifying the crediting to our bank account.

Available only for lithographs and in the case of direct delivery by the supplier, payment by cash on delivery requires the customer to pay the Supplier a deposit equal to 50% of the value of the entire work purchased, with the aforementioned transfer methods, to when received, the Supplier will start to produce the ordered goods which, once completed, will be sent by courier or own personnel who will deliver it only against the balance of the order. In the event of non-collection, the following conditions regarding delivery apply. The courier's cash-on-delivery management service involves expenses that are charged to the customer, forfeited in euros 15.00 (fifteen).


8. AVAILABILITY AND DELIVERY OF PRODUCTS

The immediate availability of the products visible on the site, are intended as the sale of the photos presented in it or the related pictures in the proposed supports (Canvas, Antique canvas, PVC light and photo paper or any other available) is to be considered void, since it is about art products usually made on commission, indicatively but not necessarily within 15 days from the date of acceptance of the order. Exceptions are some stocks or special series that are available as they are printed and made in bulk and are specifically mentioned on the site, but which are nevertheless subject to exhaustion without notice.

Unless different direct agreements between customer and artist, products purchased on the site andreasmcmuller.art are delivered, at the address indicated by the customer as destination address, by courier.

In the event of repeated inability to deliver the order due to non-availability of the Customer and subsequent non-collection within 5 working days of storage at the courier's warehouses, the order will be automatically canceled and will be debited and withheld from the reimbursement of all payment costs related to transportation, storage and return to the sender.

The goods travel for the account and risk of the buyer. Any claims for damage or tampering during transport must be challenged directly and in writing to the courier and the Supplier. Upon delivery, the Customer must verify the integrity of packages, seals and quantitative and qualitative correspondence with what is indicated in the accompanying document. In case of discrepancies (packages missing compared to what is declared on the transport document, open packages, damaged packages, etc.) the same must be reported on the accompanying document and within 48 hours by email to the Supplier. to the following address: mcmuller@shibusa.art

Product deliveries will take place on all working days. The delivery of the products by the Supplier may be divided, without this implying any responsibility for the Supplier. In the hypothesis that the ordered product (s) are not in stock (even if they appear to be available on the site) the customer will be contacted by e-mail in order to inform him of the time required for the new delivery.

Upon delivery, the signature of an adult over 18 years of age will be required. No deliveries will be made to post office boxes.

For every order placed on the andreasmcmuller.art site the Supplier issues a receipt of the goods sent by e-mail to the order holder. For the issue of the receipt, the information provided by the Customer at the time of the order is binding. No change in the invoice will be possible after its issue.

Indicatively, without this implying any constraint for the Supplier and except for the availability on the market of the products, in addition to possible causes of force majeure, the goods will be delivered with the times displayed on the Site at the time of purchase.

Delivery times are indicative and in any case to be considered valid if there are no physical or structural impediments (for example, incorrect addresses or force majeure events). The contribution for transport (or carriage and transport), to be added to the price of the products purchased, is the one specifically mentioned in the price list or in special cases other communicated to the Customer through a quote.

It is possible that the package does not arrive on time or offered on the site. In this case the customer can contact the Supplier's customer service at the dedicated e-mail address and open a file to locate the package. The Supplier is not responsible for any damage or loss, direct or indirect, arising from delayed or non-delivery of the goods.


9. WARRANTY ON PRODUCTS AND MATERIALS

All the products on our site are covered by the warranty relating to our certificates and, with respect to the materials used, to the warranty of the Manufacturer and / or our supplier or guest artist, in the manner established by the latter. This guarantee is limited to the material or object sold excluding any other service as well as any compensation or compensation.

This guarantee will apply to products that present defects of conformity and / or malfunction that cannot be found at the time of purchase, provided that the product itself has been used correctly and with due diligence, ie in respect of its destination and of what is foreseen in the eventual technical documentation, with observance of the various operating rules indicated therein.

In any case, the reference legislation and the procedures for applying the guarantee are those highlighted by the manufacturer / supplier. Whoever buys a product or material through the AndreasMcMuller site, accepts with the purchase of the same, in full, the manufacturer's warranty conditions that may be independent of the Supplier's wishes. No warranty claim will be applicable in the event of negligence, neglect or damage during use as well as in cleaning or maintenance of the product. In particular, for anti-reflective, museum and / or acrylic glass, the guarantee is only valid if the cleaning is carried out with isopropyl alcohol in a moderate quantity, gently cleaning with a soft microfibre cloth.


1. 10. RETURNS

The intention to make the return must be communicated by the customer by email to the address mcmuller@shibusa.art

Any complaints can only be accepted if notified by e-mail within two days from the date of receipt of the goods, after this period all claims will lapse. The returned goods must be sent to the Supplier's headquarters after having received from the same the acknowledgment of the return communication (usually in the following 48 hours). Unless otherwise agreed with the Supplier, the shipment takes place free of charge. The goods travel at the sender's risk.


1. 11. CONDITIONS MADE BY CUSTOMER

The goods must be sent carriage paid to our warehouse.

General conditions of acceptance of returns:

For all products:

• Customer return document or document showing n. Supplier's order reference, customer code and clear reason for return;

• Products not damaged;

• Packaging and labels intact or in the same condition of supply;

• Products not purchased under promotion;

• Products returned no later than one month from the date of receipt of the goods.


1. 12. REFUND

The Supplier will proceed with the transmission of the re-credit order relating to the cost of the goods shipped within 30 working days following the shipment of the goods by the customer and in any case not before receipt of the goods. The refund will be made by bank transfer.


1. 13. PRIVACY

With the submission of the order, the Customer, pursuant to the current law on privacy and processing of personal data, declares to know and accept that the data provided by him are entered into our database in order to proceed with the execution of the order same and that can be used by the supplier for promotional, commercial and administrative purposes; he also acknowledges that his data will not be disclosed to third parties for any reason other than the execution of the order and the administrative and bureaucratic procedures relating to it.

1. 14. FORCE MAJEURE

The Supplier will make every effort to perform all the obligations assumed on the basis of this contract, deeming itself exonerated from any responsibility in case of delays or damages caused by circumstances beyond its control. In case of delay the Supplier will perform the obligations assumed as soon as reasonably possible.


1. 15. DISPUTES

This contract will be governed by Italian law and for any dispute relating to the validity, interpretation or execution of the contract, the Customer accepts the jurisdiction of the Italian state and, in any case, the application of Italian law in force at the time of the dispute, regardless of home or office, at the Court of Reggio Emilia.

1. 16. LEGAL NOTICES

The Supplier will make every reasonable effort to ensure the accuracy and completeness of the information and data available on this site.

Much of the technical information included in our site and relating to products and materials, are based on data published by the respective manufacturers that may be changed based on what will be communicated to us by the producers themselves without notice.

However, the Supplier does not guarantee and assumes no responsibility for the updating, correctness and completeness of the information provided on this site. The same applies to all links to other sites to which this site refers users. The Supplier will not be responsible for the content of the sites that are accessed via an external link.
